By using our website (https://gjevrides.com) and booking a service online, you (“the Customer”) agree to the following terms and conditions of this Liability Waiver & Service Agreement:
1. Assumption of Risk & Release of Liability
1.1. Assumption of Risk: GJ EV Rides is a private ground transportation service. The Customer acknowledges that transportation carries inherent risks, including potential traffic delays, minor vehicle incidents, and forces of nature that may affect travel time or safety.
1.2. Release of Liability: The Customer releases GJ EV Rides and its operator from all liability related to delays, service interruptions, or damages, except in cases of gross negligence or willful misconduct by the professional driver.
1.3. Vehicle Integrity: GJ EV Rides is not responsible for any damage to customer luggage, personal belongings, or electronic devices due to shifting during transport, or damage arising from pre-existing weaknesses in the Customer’s property.
1.4. Exclusion of Liability: GJ EV Rides is not liable for any damage or loss of time caused by circumstances outside of our direct control, including, but not limited to, severe weather, traffic closures, road construction, or mechanical issues encountered en route.
2. Customer Responsibilities & Conduct
2.1. Safe Conduct: The Customer and all passengers are required to adhere to all applicable laws, including seatbelt usage, and must strictly follow the professional driver’s instructions regarding safety and conduct inside the vehicle at all times.
2.2. Passenger & Luggage Limits: The Customer is responsible for ensuring the party does not exceed the maximum limit of 4 passengers and that luggage size/weight is reasonable for the vehicle’s capacity.
2.3. Prohibited Activities: Smoking, vaping, and the use of illicit substances are strictly prohibited inside the vehicle. The Customer acknowledges that any excessive mess or damage to the vehicle’s interior caused by the party will result in a cleaning/damage fee billed directly to the Customer.
2.4. Accurate Booking Information: The Customer must ensure all pickup locations, drop-off details, and timing provided during the reservation process are accurate and complete to prevent delays or service failure.
3. Payment Terms & Cancellation Policy
3.1. Full Pre-Payment Required: All service packages (Hourly, Airport Shuttle, Point-to-Point, Tours, etc.) require payment in full, in advance at the time of booking to secure the reservation.
3.2. Hourly Billing: For hourly charters, billing begins at the scheduled pickup time and ends at the final drop-off location.
3.3. Cancellation Policy:
- Cancellations made more than 48 hours in advance are eligible for a 100% full refund.
- Cancellations made less than 48 hours in advance are non-refundable.
3.4. Refusal of Service: The driver reserves the right to refuse or terminate service without refund if passengers are excessively intoxicated, violate safety instructions, or engage in conduct that jeopardizes the safety of the vehicle or driver.
4. Worker Safety & Customer Indemnification
4.1. Driver Safety: The professional driver assumes all responsibility for their own safety during the service.
4.2. Indemnification: The Customer agrees to hold harmless and indemnify GJ EV Rides, its owners, and its professional driver from any claims, damages, or legal actions arising from the service, except in cases of gross negligence by the driver.
4.3. Third-Party Interference: GJ EV Rides is not responsible for any damages, injuries, or accidents resulting from interference by third parties (e.g., non-passengers, other vehicles, or unexpected road incidents).
5. Force Majeure (Uncontrollable Circumstances)
5.1. Uncontrollable Events: GJ EV Rides is not liable for failure to perform services due to events beyond its control, including but not limited to severe weather, road closures (e.g., I-70 or mountain pass closures), natural disasters, acts of terrorism, or equipment failure.
5.2. Resolution: In such cases, GJ EV Rides will make every reasonable effort to reschedule the service or provide a prorated refund where service was not completed.
6. Acceptance of Terms
By booking an appointment on https://gjevrides.com, the Customer acknowledges they have read, understood, and agreed to this Liability Waiver & Service Agreement.
